US Court Orders Freedom of Abrego Garcia from ICE Custody
A court has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement lacks legal authority.
"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.
The case originates in a mistaken removal to El Salvador in March, which the government later acknowledged was an error. Following his return to the United States to answer alien smuggling charges, he was detained in federal detention.
In her order, the court noted that the government does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

The legal proceedings center on conflicting claims. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.
