The former personal attorney for Donald Trump has left her position as the chief federal prosecutor in the state. This decision was prompted by a legal ruling that challenged her right to hold the office.
Official Departure
The nation's top law enforcement official, the Attorney General, announced the prosecutor's departure on the start of the week. In a statement that the court's "flawed" ruling made it "untenable" for Habba to effectively run her office.
"Let no one confuse compliance for surrender," she declared. "This battle will now stretch across the nation."
Judicial Challenge
Her resignation was triggered by a federal appellate panel found that she had been acting without proper authority as US attorney. This ruling is likely to affect numerous legal proceedings in New Jersey.
The judicial panel said that a temporary posting that bypassed Senate approval ran afoul of the statute on vacant positions.

The Attorney General added that she will remain at the DOJ as a senior adviser. They intend to seek further review of the disqualification, in the hope of achieving a reversal.
Writing online, Bondi contended that the court "should not be able to countermand the executive's selection of prosecutors entrusted with carrying out the executive branch's core responsibility of criminal prosecution."

Legal Career
Habba, originally became part of Trump's personal legal team in recent years. She went on to represented the former president in his hush-money trial in 2024, when he was guilty verdict on dozens of charges of document fraud.
